Robert F. Kennedy, Jr. and Children's Health Defense file class action lawsuit against Biden, Fauci, CDC, FBI and others alleging coordinated censorship with social media companies.
In a 120-page lawsuit, the plaintiffs claim that several government officials and agencies conspired with social media giants to suppress their constitutionally protected free speech.
According to the suit, the government and social media companies colluded to suppress free speech regarding the Hunter Biden laptop story, the Wuhan lab leak theory, and the Covid-19 vaccines.
The lawsuit mentions a 1973 United States Supreme Court ruling NORWOOD v. HARRISON (1973), where in that ruling it quotes a 1967 Supreme Court ruling Lee v. Macon County Board of Education, that says the government “may not induce, encourage, or promote private persons to accomplish what it is constitutionally forbidden to accomplish.”
They also cite another Supreme Court ruling in their lawsuit that describes the first amendment rights of Americans, and how it interprets social media. In that Supreme Court ruling it referred to social media as "the modern public square" in PACKINGHAM v. NORTH CAROLINA.
The plaintiffs evidence is based on the release of the Twitter files, other lawsuits and news reports.
The lawsuit does not seek any form of financial relief, but asks the named Defendants declare their conduct violates the First Amendment, and requests injunctive relief against further government censorship online.
