Ontario Judge acquits man charged with mischief and obstructing police for refilling jerry cans at freedom convoy protest in Ottawa.
An Ottawa police investigation into a child’s wagon carrying jerry cans to fuel the convoy protestors’ vehicles in Ottawa has resulted in the accused, Allen Remley, being acquitted of mischief and obstructing police charges.
Justice Heather Perkins-McVey ruled that the Crown failed to prove its case against Remley, that the investigating officer's notes were inadequate, and that Remley was not afforded an opportunity to speak with a lawyer.
On Feb. 12, 2022, the investigation began after police officers were briefed that refilling jerry cans was illegal and considered mischief by their superiors.
Police accused Remley of committing mischief by helping the convoy protestors through the refilling of jerry cans in what they referred to as a "mobile gas station" located at Kent and Nepean streets.
In her acquittal, Justice Perkins-McVey noted that there was no evidence suggesting Remley obstructed the officer's duties. In addition, the judge stated that there was no evidence that Remley had "incited the crowd."
I wonder if the police will give back all those jerry cans they took! But I’m happy they’re getting acquitted!
