The crux of this case revolves around the FDA's repeated advisories against the use of ivermectin for COVID treatment, coupled with strong statements urging individuals to refrain from taking the drug. The backdrop of the case involves three doctors who contend that the FDA's statements unlawfully interfered with their medical practices. A federal judge dismissed the case in 2022, which has prompted this appeal.

A lawyer representing the U.S. Food and Drug Administration (FDA) has now stated on the record that doctors possess the freedom to prescribe ivermectin as a treatment for COVID.

Ashley Cheung Honold, a Department of Justice lawyer representing the FDA, made this assertion during oral arguments on August 8th in the U.S. Court of Appeals for the 5th Circuit.

In her statement, she said, “The FDA explicitly recognizes that doctors do have the authority to prescribe ivermectin to treat COVID,” and therefore claimed that the FDA “was not interfering with the authority of doctors to prescribe drugs or to practice medicine.”
